HIV man jailed for unprotected sex

Thu February 23, 2012 2:01pm

AN HIV positive man who had unprotected sex with a woman who was later diagnosed with the virus has been jailed for two years.

The Victorian County Court was told the 52-year-old man went home with the woman, her sister and another friend after a night out drinking in Melbourne.

He had unprotected sex with the woman before indecently assaulting her sister in another room.

Judge Mark Gamble said the woman took a blood test weeks later confirming she was HIV positive.

Judge Gamble said the man had breached the woman's trust by failing to disclose his HIV status, and she suffered considerable anguish and concern about her fate.

The man pleaded guilty to one count of reckless conduct endangering persons and one count of indecent assault.

He will serve a minimum nine months before being eligible for parole.
