OPTUS PROMOTION
TERMS AND CONDITIONS
- Information on how to enter and prizes forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
- Entry is limited to Optus Mobile Digital and Optus Internet customers ("Entrants") who are Australian residents. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Optus Service Provider, MobileSat, Optus Corporate and Optus CDMA customers are also ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
- The Promoter, in its absolute discretion, reserves the right to verify the validity of all entries and Entrants, at any time, (including an Entrant's identity, age and place of residence) and to disqualify any Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process, including but not limited to, using techniques designed to avoid payment of WAP or GPRS costs. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
- Promotion commences 12:01am AEST on 01/05/2008. Final entries close 11:59pm AEST on 31/07/2008. All valid entries received during the entire promotion will be entered into a random draw. The draw will take place at Optus Administration Pty Ltd, 1 Lyonpark Road, Macquarie Park, NSW 2113 at 3:00pm AEST on 13/08/2008. The winner will be contacted by the Promoter via phone and email. The name of the winner of the prize will be published in The Australian on 20/08/2008.
- Incomplete or indecipherable entries will be deemed invalid.
- Entry must be made via one of the following three ways:
(a) Optus Mobile customers with an capable mobile phone can enter by purchasing mobile content from the Optus Zoo Optus Zoo Disney/Pixar Mobile (WAP) Site available on Optus Zoo during the promotional period. Customers who qualify for entry will automatically be entered into the draw upon purchasing the content, depending on the Mobile (WAP) content purchased. Standard WAP/GPRS charges may apply. Customers may be charged up to a maximum of $6.60 (including GST) to purchase the content plus any WAP or GPRS downloading and connection charges. Each piece of mobile content purchased from the Disney/Pixar Mobile (WAP) sites during the promotional period will give you one entry into the draw.
(b) Optus Internet customers can enter by fully completing and submitting the online entry form available at www.optuszoo.com.au/competitions.
(c) Individuals can also enter by completing the entry form available through the Optus 'yes' tickets service at www.yestickets.com.au. Entrants must be registered as a 'yes' tickets member during the promotional period to enter via the 'yes' tickets website. Entrants can only enter once via the 'yes' tickets website.
Individuals who enter the promotion through Optus www.yestickets.com.au between 12:01am AEST on 01/05/2008 and 11:59pm AEST on 15/05/2008 also have the chance to win a family pass for 4 people to the Australian Premiere of Prince Caspian: The Chronicles of Narnia taking place in Sydney on the 25th of May, 2008 at the State Theatre. This prize is valued at $400 and will be awarded to the first valid entry drawn from all 'yes' Tickets Entrants.
This prize is only available to Optus 'yes' Tickets Entrants. Entrants must be registered as a 'yes' Tickets member during the promotional period to enter via the 'yes' Tickets website. Eligible Entrants will only receive one entry into this draw via the 'yes' Tickets website.
If the winner is not from Sydney, it is the winner's responsibility to make their way to Sydney to take the prize. Any costs associated with the winner travelling to Sydney or any ancillary costs associated with taking the prize will be the winner's responsibility.
- All Entrants must be a valid, active Optus customers with an account that is not overdue for payment at the time of the draw to be eligible to win a prize.
- If there is a dispute as to the identity of an entrant, the entrant will be deemed to be the person in whose name the mobile phone account is held.
- The Promoter's decision is final and no correspondence will be entered into.
- Multiple entries are permitted except entries via 'yes' tickets, however entry is limited to one entry per content purchase or completion of the online entry form. The use of any automated entry
software or any other mechanical or electronic means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid. Each entry must be submitted separately and in accordance with entry requirements.
- All entries are deemed to be received at the time of receipt of the qualifying purchase or online entry form by the Promoter and not at the time of transmission.
- The first valid entry drawn from all entries received in the major prize draw will win a trip for 2 adults and 2 children (children are classed as the age of 11 years of age and under) to Christchurch, New Zealand valued at up to AUD$7,720 (depending on date and departure point) including economy return airfares with flights departing from Adelaide, Brisbane, Melbourne, Perth or Sydney only. Any costs associated with travel to either Adelaide, Brisbane, Melbourne, Perth or Sydney airports are the responsibility of the winner. Prize also includes 7 days of Spirit 4 Campervan hire in New Zealand with Maui Rentals including the Maui Premium Package. The Campervan comes with shower, toilet, 4 burner gas stove, fridge, microwave, air conditioning in the drivers cab, heating in the rear cabin, pressurised hot and cold water, power steering, radio and CD player, linen and bedding and kitchen equipment for use while on the Campervan. Spending money, fuel, meals, taxes (including any tax liability incurred by taking the prize), surcharges, insurance, passports, visas, transport to and from departure point, transfers, items of a personal nature, and all other ancillary costs are not included. Travel insurance is not included in the prize and will be the responsibility of the winner. Travel insurance is highly recommended. Compliance with any health or other government requirements is the responsibility of the winner and their companions.
- The Maui Premium Package includes:
- Excess Reduction 2 (with no excess to pay);
- No Worries Cover (to cover overhead and under body vehicle damage);
- Pre-Purchased Gas, which does not need to be replaced when the vehicle is returned
- Payment of Diesel Tax Recovery Fee;
- 1 x camping table for use during the Campervan hire;
- 4 x camping chairs for use during the Campervan hire; and
- 1 x child or booster chair.
- Total prize pool value is AUD$8,120.00. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. All components of each prize must be taken together by the prize winner or are otherwise deemed forfeited.
- The Major prize must be taken within 12 months of the draw date and is subject to booking and flight availability. No extension of the validity date of this prize is permitted. Notice of intention of travel must be received by Walt Disney Studios Motion Pictures Australia at least 4 weeks prior to the winner's proposed travel dates. Full contact details will be given to the winner. Any alterations to confirmed flight details will be at the expense of the winner. All four prize seats must be used by passengers travelling together in both directions.
- Major prize winner must be 18 years and over to rent the Maui Spirit 4 Campervan and carry a full Australian or New Zealand driver's license. Campervan hire is subject to standard rental conditions. Petrol and insurance is not included. The Campervan must be picked up and dropped off in Christchurch. The winner must provide a NZ$220 credit card authority imprint upon pick up of the vehicle as a security deposit.
- If the winner of any prize is under the age of 18, the prize will be awarded to the winner's parent or guardian.
- The first valid entry drawn for the 'yes' Tickets exclusive prize will win a family pass for four people to the Australian Premiere of Prince Caspian. The red carpet will take place on Sunday 25 May at the State Theatre in Sydney. Total prize value is $400. Prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. All components of the prize must be taken together by the prize winner or are otherwise deemed forfeited.
- During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age.
- The winner (and any companion) is responsible for ensuring that they have valid passports, and any requisite visas and travel documentation.
- The winner (and any companion) must depart from and return to the same departure point and travel together.
- If for any reason a winner does not take the prize or an element of the prize at the time stipulated by the Promoter, then the prize or that element of the prize will not be redeemable for cash.
- Frequent Flyer points will not form part of this prize. Tickets are non-refundable, non-transferable and non-endorseable.
- Subject to the terms and conditions of the participating prize provider(s), if for any reason a winner does not, once the prize has been booked, take the prize or an element of the prize at the time stipulated, then the prize or that element of the prize will be forfeited and will not be redeemable for cash.
- If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
- Any costs associated with accessing the promotional website or mobile WAP sites are the Entrants' responsibility and are dependent on the internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
- A draw for the major prize, if unclaimed, may take place on 13/11/2008 at the same time and place as the original draw, subject to any written directions from a regulatory authority. In the event of any winner in the unclaimed prize draw their name will be published in The Australian on 20/11/2008.
- If the winner of the 'yes' Tickets prize is not from South Austrlaia, they have until 9am AEST on 21/05/2008 to claim the prize. If the winner does not come forward to claim their prize by this date, an unclaimed prize draw will take place at the same time and place as the original draw. In the event of a winner, their names will be published in The Australian on 23/05/2008. If the winner is from South Australia, they have until 13/11/2008 to claim their prize. If the winner does not come forward to claim their prize by this date, an unclaimed prize draw will take place at the same time and place at the original draw, subject to any written directions from a regulatory authority. In the event of a winner, they will be awarded a prize to the equal value of the original prize. The winner's name will be published in The Australian on 20/11/2008.
- If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
- Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) if the Prince Caspian: The Chronicles of Narnia premier is cancelled or rescheduled due to any reason beyond the control of the Promoter (e) any variation in prize value to that stated in these Terms and Conditions; (f) any tax liability incurred by a winner or entrant; or (g) use of the prize.
- Entrants consent to the Promoter using the Entrant's name, likeness, image and/or voice in the event they are a winner (including photography, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. On behalf of Optus, third parties that manage the Prince Caspian Optus Zoo Disney/Pixar Mobile (WAP) sites and the mobile content available for purchase, and the 'yes' tickets website will capture Entrants’ mobile numbers and details for the sole purpose of registering that individual into the competition. This information will be provided to Optus so that the Entrant can be entered into the draw.
- All entries become the property of the Promoter. The Promoter and third parties on behalf of Optus collect Entrants' personal information in order to conduct the promotion. By purchasing mobile content the Disney/Pixar Mobile (WAP) site or by filling in the online entry form, or by entering via 'yes' tickets Entrants will be entered into the promotion. By entering the promotion, unless otherwise advised, each Entrant consents to the information they submit with their entry being entered into a database and the Promoter and its related bodies corporate may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the Entrant including sending the Entrant electronic messages. All personal details of the Entrant provided by entering the promotion will be stored at the office of the Promoter. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. - As a condition of accepting the prize, the winner (and their companions) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
